The agreement
By using this website, submitting a form, booking a conversation, or accepting a MelGroup proposal, you agree to these Terms. If you are acting for a company, you represent that you have authority to bind that company. If you do not agree, do not use the site or request work.
Website use
The website is provided to present MelGroup’s practice, selected work, and a way to begin a conversation. Content is for information. It is not legal, financial, architectural, or engineering advice. Concept or demonstration work is labeled when it is not a completed client engagement.
You may not misuse the site: no scraping at a scale that impairs the service, no injecting malicious code, no impersonation, and no attempt to access systems or data that are not yours. We may suspend access that threatens the studio or other visitors.
Services
MelGroup offers professional creative and digital services, which may include — depending on a written scope —
- Marketing and creative direction
- Website design and development
- Branding and identity
- CRM and marketing automation
- AI-related studio services used with human direction and restraint
- 3D visualization and related presentation work
- Marketing and lead-generation programs
- Strategy consultations
3D visualization is a design and sales instrument. It is not architecture, engineering, or a construction document unless a separate licensed professional is engaged in writing. AI-related work is a studio tool under MelGroup’s direction; outputs are reviewed for the engagement and are not a substitute for your own professional, legal, or financial judgment.
Client responsibilities
You are responsible for providing timely, accurate materials and decisions MelGroup needs to perform the work: copy, access, brand assets, product facts, approvals, and the authority to use third-party accounts you ask us to connect. Delays in your materials delay the work. You remain responsible for the accuracy of claims about your business and for any licenses required for content you supply.
Proposals and project scopes
Website copy, service pages, and conversations describe capability. They are not a quote. Fees, deliverables, rounds of revision, and schedule exist only when stated in a written proposal or agreement that you accept. Work outside that scope is a separate request and may require a revised proposal.
Payment
Fees are set in the written proposal for each engagement. These Terms do not list prices, retainers, or payment schedules. Invoices are due as stated in that proposal. MelGroup may pause work if an agreed payment is outstanding. Taxes, third-party licenses, advertising spend, and platform subscriptions are the client’s cost unless the proposal says otherwise.
Intellectual property
MelGroup retains ownership of its pre-existing tools, methods, internal systems, unused concepts, and the MelGroup name, marks, and website. Upon full payment, you receive the rights to project deliverables described in the accepted proposal — typically a license or assignment sufficient to use the finished work in your business — except for third-party materials (fonts, stock, plugins, platforms) which remain under their own licenses.
You grant MelGroup a limited license to use materials you provide solely to perform the engagement. You represent that you have the right to provide them.
Third-party platforms and integrations
Websites, CRM, calendars, SMS, analytics, hosting, and advertising often rely on third-party platforms. MelGroup does not control those providers’ uptime, policies, or pricing. Your use of those platforms is also subject to their terms. MelGroup is not liable for a third party’s outage, account suspension, or change of features.
No guaranteed outcomes
MelGroup does not guarantee specific revenue, a number of leads, search rankings, conversion rates, or any other business result. Markets, timing, your offer, your follow-up, and third-party algorithms are outside a studio’s control. Strategy consultations are professional opinions, not promises.
Portfolio and project display
MelGroup may display a project in its portfolio, website, or proposals only where you have permitted it in writing, or where the accepted agreement grants that right. If you require confidentiality, say so before work is published. We will not present another company’s confidential work as if it were public.
Cancellation and rescheduling
Strategy conversations may be rescheduled with reasonable notice so the studio can offer the time to someone else. Repeated no-shows may lead MelGroup to decline further bookings. Project cancellation, pause, or refund treatment — if any — is defined in the written proposal. Work already performed and non-refundable third-party costs remain payable.
Limitation of liability
To the fullest extent permitted by law, MelGroup LLC and MelGroup Marketing are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunity, arising from the website or from services — even if advised of the possibility. MelGroup’s total liability for a claim relating to the website is limited to the amount you paid (if any) to access the site, which is typically none. For paid services, MelGroup’s total liability is limited to the fees you paid to MelGroup for the specific engagement giving rise to the claim during the three months before the claim, unless a signed agreement sets a different cap. Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent allowed.
The website and any complimentary materials are provided “as is.” MelGroup does not warrant uninterrupted or error-free operation.
Prohibited use
You may not use the site or MelGroup services to break the law, infringe others’ rights, send unlawful spam, impersonate MelGroup, or reverse-engineer studio systems except as allowed by law. MelGroup may refuse work that conflicts with these Terms or with professional judgment.
Governing law
Unless a written engagement agreement between you and MelGroup LLC states otherwise, these Terms are governed by the applicable laws of the United States, without MelGroup designating a street address or a particular courthouse in this document. If a signed proposal specifies governing law or venue, that writing controls for that engagement.
Changes to these Terms
MelGroup may update these Terms. The effective date at the top of this page will change when we do. The version posted at the time you use the website or accept a proposal applies to that use, except that an accepted written agreement is not silently rewritten by a later website update.
